Reservation and Tour Agreement
This service agreement is entered into between Veliaht Turizm Ticaret Limited Şirketi (referred to as “Trip Savvy Travel” in this agreement) and the customer (referred to as the “Customer” in this agreement) who makes a reservation through www.tripsavvytravel.com, our social media accounts, our e-mail accounts, WhatsApp, or our telephone line (referred to as the “Website” in this agreement).
Where the Customer has paid the full amount or the deposit amount to Trip Savvy Travel at the time of reservation or within the specified periods, the parties are deemed to have brought the provisions of this agreement into force, and the Customer undertakes to act in accordance with the terms set out below.
Where the Customer has not made any payment at the time of reservation or within the specified periods, the reservation request is deemed not to have been approved and this agreement is deemed not to have entered into force. Trip Savvy Travel cannot be held responsible in any way for inconvenience arising in such a case.
Contents of the Agreement
General Terms and Functions of the Service
• Trip Savvy Travel undertakes, accepts and declares that it will provide the service(s) for which the Customer has made a reservation, in accordance with the route and tour content advertised on the website.
• The Customer accepts, declares and undertakes to comply with the provisions set out in this agreement, as well as any other terms and conditions announced regarding the organisation they will take part in.
• The service provided by Trip Savvy Travel consists of the departure date and time, estimated return time, and places to be visited, as advertised in the relevant tour details section of the website. Services included and not included in the tour price are listed in the relevant tour details on the website.
• The detailed tour itinerary is an integral part of this agreement, and the Customer is deemed to have accepted this agreement at the time of making the reservation.
• Trip Savvy Travel may, where it deems necessary, change the order or timing of places visited, before or during the tour, without prior notice, provided this remains within the category specified in the tour programme on the Website.
Reservation and Payment Conditions
• Once the Customer makes a reservation and payment for the relevant service advertised on the website, and a Trip Savvy Travel representative confirms these transactions, this agreement and the related travel programmes are deemed to have been read by the Customer. In this way, the reservation and sale become final and binding.
• A Customer making a reservation on behalf of multiple individuals or a group is responsible for providing complete information regarding the terms and conditions and the detailed programme to the other individuals named in the reservation, and for obtaining their consent. The other individuals are deemed to be aware of their own duties and responsibilities. The Customer is responsible for disputes arising from any shortcomings on the part of those other individuals, but Trip Savvy Travel cannot be held responsible in any way.
• To confirm your reservation, the full tour/activity amount must be paid no later than 24 hours before the start date of the tour. Payment dates, amounts and methods are also specified in each detailed tour programme.
• Where payments must be made in Turkish Lira (TRY-₺) rather than in a foreign currency, the CBRT (TCMB) exchange rate will be used.
• Bank fees, commissions and transfer charges, as well as any service-provider deductions that differ from the tour price paid by the Customer, are the Customer's responsibility. The amount payable to Trip Savvy Travel is specified on the website.
• Trip Savvy Travel is required to arrange mandatory travel insurance for Customers on accommodation-based tours. As no such insurance is available for tours of less than 24 hours, insurance is provided only for accommodation-based tours. The provisions of the relevant insurance contract apply. If the Customer is unable to determine the adequacy of the mandatory travel insurance, they may purchase separate insurance; however, in this case the Customer may not request cancellation or a premium refund from Trip Savvy Travel.
Mandatory Changes and Resulting Tour Cancellations
• Trip Savvy Travel cannot be held responsible for any direct or indirect damage or loss arising from adverse or unforeseeable consequences caused by natural disasters (earthquake, flood, fire, typhoon, landslide, etc.), emergencies (war, terrorism, etc.), public unrest (strikes, marches, road closures, etc.), health issues (epidemics, quarantine, etc.), extraordinary weather conditions (heavy snowfall and blizzards, fog, severe storms, lightning, etc.), travel advisories, intergovernmental diplomatic issues and tensions, or the liquidation of any reserved transport company and/or hotel. Trip Savvy Travel is, however, responsible for its own obligations and cannot assume material or moral liability. For these reasons, Trip Savvy Travel reserves the right to change or cancel the tour.
• Notwithstanding any agreements between Trip Savvy Travel and transport providers, Trip Savvy Travel cannot assume responsibility for delays, breakdowns, accidents or personal faults on the part of its drivers, and no material or moral liability may be attributed to Trip Savvy Travel in this respect. Trip Savvy Travel cannot be held responsible for any changes, delays or cancellations that may occur in connection with flight schedules. The Customer acknowledges and accepts that changes and rearrangements may be made by the airline within the framework of international aviation rules.
Trip Savvy Travel and Customer Cancellation Conditions
• The Customer is obliged to make payment within the specified period. Trip Savvy Travel reserves the right to cancel the reservation of a Customer who does not make payment on time.
• Where the Customer delays payment due to compelling reasons, Trip Savvy Travel may not apply any form of late-payment interest. However, the Customer must pay the full reservation amount no later than 24 hours before the start date of the tour.
• Where the Customer cancels their reservation, for any reason, up to 24 hours before the tour/activity date, the full amount paid is refunded to them. Refunds are made within 30 business days from the date of cancellation, to the account or credit card used to pay Trip Savvy Travel.
• Cancellations made by the Customer less than 24 hours before the tour/activity date are non-refundable.
• If Trip Savvy Travel cancels a reservation for any valid reason, it will refund all payments received from the Customer (excluding flight, concert and event tickets, and hotel fees).
• Trip Savvy Travel has the right to cancel a tour without the Customer's consent, on the sole condition of informing the Customer, as follows from the tour start date: 2 days before day tours, 2 days before city tours, 2 days before domestic tours, and 15 days before international tours. In the event of such a cancellation, Trip Savvy Travel is obliged to refund the fee received from the Customer. However, the Customer may not claim compensation for the cancellation. Trip Savvy Travel is not responsible for any losses arising from the Customer's flight or hotel upgrades or use of mileage.
• The Customer may transfer a purchased tour to another person up to 3 days before city tours, 20 days before domestic tours, and 30 days before international tours. Trip Savvy Travel undertakes to make every effort to extend this period in the Customer's favour. The transferee is jointly responsible with the transferor for any costs arising from the transfer. The transferee is bound by the terms of this agreement, even without having signed this agreement or any related forms.
• The refund made to the Customer is made in the currency in which the Customer made the payment to Trip Savvy Travel.
Trip Savvy Travel and Customer Faults
• Except for the reasons specified in clauses 1, 2, 3 and 4 of this agreement, Trip Savvy Travel undertakes to refund all fees paid by the Customer in the event of non-compliance with the terms of this agreement.
• If the Customer proves that they were unable to receive any service included in the tour programme due to the fault or negligence of persons representing Trip Savvy Travel (such as guides, drivers, tour leaders, etc.), Trip Savvy Travel will refund the corresponding portion of the tour fee to the Customer. However, if the Customer cannot substantiate their complaint, they forfeit their right to a refund or reimbursement.
• The Customer is responsible for all consequences arising from late payments and from documents that are not delivered on time and in full. In such cases, Trip Savvy Travel reserves the right to cancel this agreement and the Customer's participation in the tour.
• The Customer warrants that the information and documents provided to Trip Savvy Travel are accurate and complete. Trip Savvy Travel uses this information and these documents in its tourism organisations. Legal liabilities arising from the falseness, inaccuracy or incompleteness of these documents belong to the Customer.
• The Customer is responsible in the event of any prohibition, arrest at the airport, detention or apprehension at the border by a court or law enforcement authority for any reason, and may not request a refund or reimbursement.
• The Customer is responsible for being ready at the specified meeting point at the specified start time of the tour, for not missing their flight, and for any lateness for any reason. In such cases, the Customer may not hold Trip Savvy Travel responsible or request a refund.
• Trip Savvy Travel is not responsible if the Customer abandons the tour for personal reasons or does not wish to stay at the designated hotel.
• The Customer cannot be held responsible for health issues. In the case of cancellation requests due to health problems arising shortly before the tour start date, a refund will be made within 30 days after a medical report obtained from the relevant healthcare institution has been submitted to Trip Savvy Travel. It is the Customer's responsibility to assess the suitability of the tour programme and the journey from a health and physical-fitness perspective.
• The Customer is responsible for any material damage they cause to vehicles and any equipment used on the tours, at hotels, or at other establishments. Trip Savvy Travel cannot be held responsible for any obligations or compensation arising from this.
• All expenses not included in the price of the detailed tour programme are the Customer's responsibility and must be paid by them.
• The Customer is responsible for the security of all documents and valuables — such as identification, passport and driving licence — purchased or already in their possession during the tour. Trip Savvy Travel cannot be held responsible for the loss or theft of such items.
• Tour guides are obliged to provide clear information regarding the course of the tour. The Customer assumes responsibility for failing to hear, forgetting, or knowingly disregarding general announcements made during the tour.
• The Customer undertakes to respect the rules of the tour programme, the rules of the country and location they are in, and the rights of other participants on the tour. The Customer is responsible for any problems or damage arising from non-compliance, and neither Trip Savvy Travel nor other customers may be held liable.
Disputes
• The provisions of this agreement are governed by Turkish law.
• In any dispute arising from this agreement, Trip Savvy Travel's records will be accepted as conclusive evidence.
• The courts and enforcement offices of Nevşehir have jurisdiction to resolve any dispute arising from this agreement.
Trip Savvy Travel reserves the right to modify the terms set out in this agreement.
